I tried running the second version of your function in Mono, and got an invalid IL error. I don't have time to test it on my Windows box ATM, but I think I may have found your problem here:

Specifically this line:

Byref types may not be used as generic arguments

Although it seems to indicate that this is to be checked at compile time, so it may be a bug.
